Agreement to Terms
By accessing or using Hyder Concrete's services, you agree to be bound by these Terms of Service and acknowledge that you have read, understood, and agree to be bound by all terms and conditions herein. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access or use our services, including our website, phone consultations, estimates, and on-site concrete services in Tennessee.
Hyder Concrete Company is a division of Hyder Paving LLC, a family-owned business serving the Tri-Cities Tennessee area since 1974. These terms govern all concrete-specific services offered under the Hyder Concrete brand.
Services Offered
Hyder Concrete provides professional concrete and related services including, but not limited to: concrete flatwork, residential and commercial driveways, patios and walkways, foundations and slabs, decorative and stamped concrete, exposed aggregate, concrete repair and restoration, concrete sealing and waterproofing, curbing, retaining walls, and site preparation. All services are provided in the Tri-Cities Tennessee area, surrounding counties, and regions within our normal service area as determined by the contractor.
Seasonal and Weather Limitations: Concrete work is subject to weather limitations including minimum ambient temperature of 40°F for 24 hours before, during, and after placement; maximum ambient temperature of 90°F for standard pours without hot-weather precautions; and precipitation delays. Concrete poured in marginal conditions risks surface defects, reduced strength, or premature cracking. Work scheduled during marginal weather periods may be rescheduled without penalty to protect the integrity of your project.
Estimates and Pricing
Free estimates are provided in good faith based on visual inspection and information available at time of estimate. Final pricing may vary based on actual site conditions discovered during excavation, subsurface conditions, changes to project scope, material cost fluctuations, permit requirements, utility conflicts, or unforeseen conditions. Estimates are valid for 30 days from date issued. Any changes to pricing exceeding 10% of the original estimate will be communicated and approved in writing before proceeding.
Subgrade Conditions: Estimates assume stable subgrade conditions. Additional charges apply for rock excavation, unsuitable soil removal, geotextile fabric installation, additional base material, dewatering operations, or soil stabilization. Customer is responsible for disclosing known subsurface conditions including previous utilities, buried debris, or soil contamination.

All calculators, estimators, and pricing tools on our website provide ESTIMATES ONLY and are for informational purposes only. These tools are not binding quotes, guarantees, or promises of actual costs or returns.
Calculator results and estimates:
- Are approximations based on general assumptions and average conditions
- Do not account for site-specific conditions, complications, or requirements
- May not reflect current material costs or market conditions
- Do not constitute a formal quote or contractual offer
- Are subject to significant variation based on actual project requirements
- Should not be relied upon for budgeting without obtaining a formal written estimate
ACTUAL COSTS MAY VARY SIGNIFICANTLY from calculator estimates. For accurate pricing, you must obtain a formal written estimate after on-site evaluation. Hyder Concrete disclaims all liability for discrepancies between calculator estimates and actual costs.
Payment Terms
Payment terms will be clearly specified in your written estimate or contract. For residential projects under $5,000, payment is typically required in full upon completion. For larger projects, progress payments may be arranged as outlined in the contract. We accept cash, check, and major credit cards. Financing options may be available for qualified customers. Late payments are subject to a 1.5% monthly service charge (18% annual rate) and may result in lien filing. Customer is responsible for all collection costs and reasonable attorney fees if legal action becomes necessary.
Limited Warranty — Concrete Work
IMPORTANT WARRANTY LIMITATION — READ CAREFULLY
Contractor warrants all concrete work free from defects in workmanship for one (1) year from completion date, limited to repair or replacement at contractor's sole discretion. This workmanship warranty covers defects in installation, finishing, forming, and construction techniques when services are performed according to industry standards and specifications.

Material Warranty Disclaimer
WE DO NOT WARRANTY MATERIALS SUPPLIED BY OTHERS
Hyder Concrete provides NO WARRANTY on concrete mix, aggregates, admixtures, sealers, reinforcing steel, or any other materials used in construction. This includes but is not limited to:
- Ready-mix concrete from any supplier
- Base materials, aggregates, and stone
- Concrete sealers and surface treatments
- Reinforcing steel (rebar) and wire mesh
- Fiber reinforcement and admixtures
- Any materials provided by customer or third parties
- Any materials not manufactured by Hyder Concrete
Material warranties, if any, are provided directly by manufacturers. Customer must pursue any material defect claims directly with material manufacturers or suppliers. Hyder Concrete's warranty covers only the labor and workmanship of installation, not the materials themselves.
Contractor disclaims all implied warranties including merchantability and fitness for particular purpose regarding any materials used in construction.
WARRANTY EXCLUSIONS: Warranty specifically excludes: (a) normal wear, surface weathering, and color variation due to curing, UV exposure, or environmental factors; (b) acts of God including but not limited to freeze/thaw cycles, flooding, storms, earthquakes; (c) settlement or movement of subgrade beyond contractor's control including clay soils, expansive soils, or inadequate bearing capacity; (d) damage from vehicles exceeding design load specifications; (e) failure to perform required maintenance including sealing every 3–5 years and prompt crack repair; (f) damage from deicers (salt or chemical ice melt) applied within the first 12 months or excessively thereafter; (g) damage from snow plows with metal blades in direct contact with concrete; (h) root damage from vegetation; (i) damage from utilities or third parties; (j) changes in drainage patterns not caused by contractor; (k) cracking due to subgrade movement when customer declined recommended improvements; (l) surface crazing, scaling, or spalling due to freeze/thaw when deicing chemicals are present.
MAINTENANCE REQUIREMENTS: Warranty validity requires: (a) concrete sealing every 3–5 years beginning no later than 12 months after installation; (b) prompt repair of cracks exceeding 1/4 inch; (c) proper drainage maintenance to prevent water ponding or infiltration; (d) avoidance of deicers (calcium chloride, rock salt, or chemical ice melt) for the first 12 months; (e) snow removal without metal blades in direct contact with concrete surface; (f) avoidance of heavy loads during the first 28-day cure period.
Concrete Curing and Initial Care
Customer acknowledges that new concrete requires a full 28-day cure period to reach design strength. During this period: (a) vehicle traffic should be avoided for a minimum of 7 days (light foot traffic after 24–48 hours); (b) heavy vehicles and equipment should not be permitted for 28 days; (c) concrete should not be exposed to deicing chemicals or freeze/thaw cycles during initial cure; (d) maintain adequate drainage to prevent water ponding on fresh concrete; (e) edge support is critical—unsupported concrete edges are subject to cracking and are not covered under warranty.
Limitation of Liability
IMPORTANT LIABILITY LIMITATION
Contractor's total liability for any claim, whether in contract, tort, or otherwise, shall not exceed the total contract value paid by customer. Contractor shall not be liable for indirect, incidental, consequential, or special damages; lost profits; business interruption; or punitive damages under any circumstances.
Contractor is not liable for: (a) underground utilities not properly marked by Tennessee 811 utility location service; (b) subsurface conditions including rock, water, contaminated soil, underground fuel tanks, or underground structures not disclosed; (c) weather-related delays or damage; (d) third-party claims except for contractor negligence; (e) damage to landscaping, sprinkler systems, or other improvements not included in scope of work; (f) settling or cracking due to inadequate subgrade preparation when customer declines recommended improvements; (g) environmental contamination discovered during excavation; (h) delays due to permit requirements or regulatory compliance; (i) concrete color variation, efflorescence, or surface texture differences between samples and installed work.
Material Limitations: Contractor disclaims liability for concrete material defects, aggregate quality variations, or supplier delivery delays. Ready-mix concrete is manufactured to specified mix designs, but natural material variations—including color, surface texture, and aggregate exposure—are inherent to concrete and are not grounds for warranty claims.
Site Conditions and Customer Responsibilities
Customer is responsible for: (a) ensuring contractor has safe and reasonable access to the work area with minimum 12-foot clearance for equipment and concrete trucks; (b) removing or protecting personal property, vehicles, and landscaping; (c) calling Tennessee 811 utility location service 48 hours before work begins; (d) providing accurate property boundaries and utility locations; (e) obtaining necessary permits unless specifically included in contract; (f) ensuring pets are restrained during work; (g) maintaining adequate drainage after completion; (h) disclosing any known environmental contamination or underground storage tanks; (i) providing access to water supply if required for curing operations.
Change Orders and Additional Work
Any changes to the original scope of work must be approved in writing with pricing specified before work begins. Additional work due to unforeseen conditions will be charged at prevailing rates: equipment time, materials at cost plus 20%, and labor as specified. Customer has the right to refuse additional work, but contractor may suspend work until conditions are resolved.
Weather and Force Majeure
Concrete placement requires specific weather conditions. Work may be delayed or suspended due to rain, temperatures below 40°F or above 90°F, high humidity, direct sunlight causing rapid evaporation, or other adverse conditions that would compromise concrete quality. Contractor is not liable for delays due to weather, acts of God, government actions, labor disputes, material shortages (including ready-mix plant outages), or other circumstances beyond contractor's reasonable control.
Governing Law and Dispute Resolution
These terms are governed by Tennessee state law. Any disputes shall be resolved in the courts of Washington County, Tennessee. Customer agrees to attempt mediation before filing suit. In any legal proceeding, the prevailing party is entitled to reasonable attorney fees and costs. If any provision is deemed unenforceable, remaining provisions remain in full effect.
Insurance and Compliance
Hyder Concrete maintains comprehensive general liability insurance and workers' compensation coverage. We are fully insured and bonded for your protection. Surety bonding is available for projects requiring bonded contractors, and we comply with all applicable local, state, and federal regulations.
This contract is subject to Tennessee contractor lien laws (Tennessee Code Annotated Title 66, Chapter 11). Contractor has the right to file a mechanics' lien for unpaid work. Customer has three (3) business days to cancel this contract after signing for contracts over $25 (Tennessee Consumer Protection Act). This contract complies with Tennessee Department of Commerce and Insurance contractor regulations.
Utility Compliance: All work complies with Tennessee 811 utility location requirements. Customer acknowledges that utility locating is required by Tennessee law and that contractor is not responsible for unmarked or incorrectly marked utilities.
Modifications and Entire Agreement
These terms may only be modified in writing signed by both parties. These terms, together with any written contract or estimate, constitute the entire agreement and supersede all prior negotiations, representations, or agreements. No verbal agreements or promises not contained in writing are binding.
